A LOCAL LAW TO ESTABLISH WATER AND SEWER RATES

FOR THE VILLAGE OF HERKIMER, NEW YORK

 

 

            WHEREAS, the Village of Herkimer desires to establish a uniform schedule of fees and charges for Water and Sewer and related services applicable throughout the Village

 

         NOW, THEREFORE,

 

         BE IT ENACTED by the Board of Trustees of the Village of Herkimer, New York, that the following shall constitute the schedule of fees and charges relating to water and sewer rates for the Village of Herkimer and outside services:

 

Section 1.     Water and Sewer Rates:

 

         WATER RATE FOR THREE MONTHS USE:

 

         Gallon meter usage is converted to cubic feet and billed at the following rates:  One UNIT (cubic foot measurement) equals 100 cubic feet or 748 gallons.  One-GALLON UNIT equals 100 gallons.  CU on the bills indicates cubic foot meters; GA indicates gallon meters.

        

A.              URBAN RESIDENTIAL RATE (Cubic Foot Rate)

 

First 30 units, each        $ 2.90

Next 30 units, each          2.46

Next 40 units, each          2.29

Next 75 units, each          1.93

Next 200 units, each        1.45

                    

B.              URBAN RESIDENTIAL RATE:           MINIMUM CHARGE: $18.00

 

(1)            The minimum quarterly charges based on the size of the water meter

shall be made in all instances where the cost of the water used at the Regular Service Rate does not equal or exceed the amount of the Minimum quarterly charges, as set forth herein.  Meters in service 28 days or more in one reading period shall be billed at Quarterly Minimum Rates.  Those in service less than 28 days, shall be billed at one-half the Minimum Quarterly Rate.

 

(2)            The minimum quarterly charges for suburban service shall be one

and three-fourths (1.75) times the Urban Residential Minimum Charges.


 

 

(3)            The Minimum Urban Service Rates According to Meter Size shall be

as follows:

 

                        5/8” Meter                       $ 18.00 per quarter

                        3/4” Meter                          27.00 per quarter

                            1” Meter                          35.00 per quarter

                         1 ½ Meter                          60.00 per quarter

                           2” Meter                        104.00 per quarter

                           3” Meter                        206.00 per quarter

                           4” Meter                        410.00 per quarter

                           6” Meter                        616.00 per quarter                                                                           8” Meter                        672.00 per quarter

                           8” Meter                          821.00 per quarter

 

C.         URBAN COMMERCIAL RATE:

 

                  An additional 25% shall be added to the above Urban Residential Rate and Minimum Meter Service Charge for commercial businesses inside the Village limits.  Commercial rates shall apply to all users, except one family residences occupied by the owners; churches, parsonages occupied by the Clergy of the religious institution; and residences, part of which are used for home occupations, as defined in the Village Zoning Ordinance or Local Law.  An additional 10% will be added to all Urban Commercial Rates that require a pump station.

 

D.         SUBURBAN RESIDENTIAL RATE:

 

                  The rates for residential users outside of the Village limits are one and three-fourths (1.75) times the Urban Residential Water Rates and Minimum Meter Service Charges.  This does not apply to contracts for water standby service with other municipalities or large wholesale customers outside the Village, for whom special rates may be made by contract with the Village.

 

E.          SUBURBAN COMMERCIAL RATE:

 

         The rates for commercial users outside of the Village Limits are established at

one and three-fourth (1.75) times the Urban Commercial Water Rates and Minimum Meter Service Charges.

 

                  This does not apply to contracts in the future with other Villages, Towns, or water districts outside the village, for whom special rates may be made the Village.


 

F.          FIRE SERVICE:

 

         An annual charge to be billed January 1st for private fire service, payable in

advance, based on the size of the connection as follows:

G.         HYDRANT RENTALS - SUBURBAN:

 

         Hydrant Rental outside the village limits is established at $160.00 per year

and will be billed annually on January 1st.

 

Section 2.     Sewer Rates:

 

                     The Sewer charges are based on water usage as measured by water consumption for quarterly use or for lesser periods as determined by ownership changes and/or installation.

 

A.              SEWER RATE FOR THREE MONTHS USE:

 

First   30 units, each       $3.13

Next   30 units, each        2.65

Next   40 units, each        2.29

Next   75 units, each        1.94

Next 125 units, each        1.48

Over 300 units, each        1.32           

 

B.              URBAN RESIDENTIAL RATE:  MINIMUM CHARGE: $20.00

 

(1)     The minimum quarterly charges based on the size of the water

                     *There is an additional fee of $100.00 for taps outside the village.

Section 3.     Miscellaneous provisions common to water and sewer rates:

 

A.         PENALTIES:

 

To all bills remaining unpaid after 28 days plus 5 business days from the date thereof, a ten percent (10%) penalty will be added, for failure to make prompt payment within the quarterly billing.  The penalty shall be applied to each additional quarter that the bill remains unpaid.

 

B.         EXTRACT OF RULES AND REGULATIONS

 

All bills are due and payable when rendered.

 

                     Failure to receive bills for water service does not relieve the owner/tenant

                     from liability to pay.

 

                     Any payment to the Village will apply to the oldest outstanding bill.

 

                     Remittances mailed will be considered as received at the time and date of

                     the postmark, subject to collection of checks.

 

         Complete Rules and Regulations may be consulted at the Water          Department Office.

 

Sprinkler Testing will be charged at the hourly rate of the employee performing the task as per the time calculated by the Village and due said employee.
